General terms and conditions

Application

  • These General Rental Conditions apply to reservations and agreements relating to Gîtes FemPèr, dog friendly gîte rental at Paunat, 1909 Route des Crêtes, 24510 Paunat France.
  • In these General Rental Conditions, the term ‘tenant’ means the person entering into an agreement with us relating to the rental of one of our gîtes.
  • These General Terms and Conditions apply regardless of your (prior) reference to any of our own terms and conditions or other general terms and conditions. We reject all General Conditions to which you refer or which are used by you.

Reservation

  • We only accept reservations from persons aged 18 or over.
  • After booking, you will receive confirmation from us within 5 working days. You should check this confirmation for accuracy and inform us immediately of any inaccuracies. If you have not received a confirmation from us within 5 working days of making the reservation, please contact us immediately, failing which the reservation cannot be invoked.
  • A contract is concluded between you and us when we have confirmed the reservation to you. The agreement concerns the rental of the gîte for recreational use, which by its nature is of short duration.
  • At check-in you (as well as your dog(s)) must be able to identify

Payment

  • We request that you transfer 25% of the rent to us within 14 days of the confirmation of receipt. The other 75% must be paid to us 1 month before the arrival date. If your reservation is within 1 month before the arrival date, you must pay 100% of the invoice amount at once upon receipt.
  • The deposit and/or payment should be transferred to IBAN: FR76 1254 8940 0103 8076 0684 035 in the name of Mme Pant Femke, quoting the invoice number.
  • By paying an instalment of or the whole rent, you confirm having read and agreed to the general terms and conditions. The rental ends automatically after the expiry of the agreed period.

Deposit

  • The deposit is € 200 per stay. The deposit must be paid in cash on arrival. The deposit serves as a guarantee for damage and/or costs – in the broadest sense of the word – that we may suffer in the event of non-compliance with the obligations of the tenant as a good tenant and the person(s) accompanying the tenant.
  • The deposit or any balance thereof will be refunded in cash upon departure after settlement of claims (damage to inventory/gîte and/or other costs) from us to the

Receipt of key

  • A time will be agreed with the tenant for handover of key. We will lend this item to the lessee. The lessee is never entitled to retain or duplicate the key for any reason whatsoever. Should the lessee nevertheless do so, the lessee will owe a fine of € 500, without prejudice to the actual costs. The key remains our property. In case of loss, theft or any other way of losing this item, the tenant will owe a sum of €25.
  • All costs incurred due to your failure to return the property on time will be recovered from you. Goods found after your departure will be kept for you for a reasonable period, but we take no responsibility for them. Goods can only be returned at your expense.

Cancellation

  • Cancellation by the tenant must always be made in writing (by post or e-mail). The following rules apply:
  • If cancelled up to 60 days before the day of arrival, 25% of the rent will be charged.
  • If cancelled from day 60 to day 30 before arrival, 50% of the rent will be charged.
  • If cancelled from day 30 to day 7 before arrival, 75% will be charged
  • Cancellation from day 7 until the day of arrival, 100% of the rent will be charged.
  • In case of cancellation on our part, any money already paid will be refunded.
  • In case of cancellation by the tenant, overpayments will be refunded in accordance with the above-mentioned terms.

Stay

  • On the day of arrival, you can in principle use the gîte from 16:00. On the day of departure, the gîte must be vacated before 10:00.
  • The gîte is non-smoking. Smoking is allowed outside on the terrace.
  • The use of all facilities in and around the gîte is at your own risk at all times.
  • The rental includes bed linen and towels, excluding bath towels.
  • Parasols should always be folded after use and in strong winds.
  • Cushions of the garden furniture should always be put back in the box by the pool in rainy weather.
  • Barbecuing with the available bbq is allowed. This must be left clean before leaving the house.
  • It is not allowed to move the bbq outside the terrace.
  • Although the use of gas, water and electricity is included, we request that you use them sparingly.
  • Subletting or re-letting is expressly forbidden.
  • Staying more persons in the gîte than agreed upon in the reservation, or more than the applicable maximum of 2 persons for the gîte, is not allowed without our permission, unless otherwise agreed upon in writing. This can lead to a premature termination of the rental agreement by us, without refund.
  • Moving cupboards and beds or taking any part of the indoor inventory outside – except of course dishes, glasses and cutlery for your meals outside – is expressly not allowed.Use fire extinguishers only in case of fire.A fire extinguisher and fire blanket are available in the kitchen.
  • Waste must be separated according to the rules in force in France.
  • Depending on weather conditions, the swimming pool is accessible from May to October.
  • Pets are not allowed in the swimming pool.

Vertrek

De gîte dient op de volgende wijze te worden achtergelaten:

  • Veegschoon achterlaten
  • Alles schoon afgewassen, afgedroogd en weer in de kasten geplaatst
  • Koelkast schoon achterlaten
  • Geen etenswaren achterlaten in de kasten
  • De lakens, hoeslakens en kussenslopen dienen te worden afgehaald en in douche te worden gedeponeerd.
  • De vuilnisbakken geleegd.
  • Eventueel breukwerk en/of schade melden bij de verhuurder.

Liability/complaints/damages

  • The tenant and other users are fully liable for all damage caused to the gîte, the inventory and all items belonging to the rented object in the respective rental period, unless the tenant and other users can make it plausible that the damage cannot be attributed to them. We therefore advise you to thoroughly inspect the gîte and its inventory for defects and shortcomings upon arrival. If you notice any damage or defects, please report this to us immediately.
  • We do not accept liability for theft, loss or damage to goods or persons, of whatever nature, during or as a result of the stay in the gîte. We accept no liability for nuisance caused by construction activities on the access and main roads or surrounding houses etc. in the vicinity of the rented gîte. We accept no liability in the event of breakdown or non-operation of technical equipment including the swimming pool, utilities, non-functioning or partial non-functioning of internet.
  • The costs of normal maintenance and repair of defects shall be borne by us. If defects occur, the tenant must notify us immediately and follow our instructions as far as possible. Any costs incurred by the tenant in this respect will be reimbursed by us to the tenant against submission of itemised bills.
  • Gîtes Fempèr has a (wireless) internet connection available for the tenant to use. It is strictly forbidden to illegally download/upload or stream from the internet! There are high fines for this and it is strictly controlled. The tenant himself is responsible and liable for his own internet use and if fines are imposed, these will be passed on to the tenant. The personal data of tenant/offender will be disclosed upon request by authorities/copyright holders. All costs incurred by the lessor in connection with such an infringement will be recovered from the lessee.
  • Should you still wish to make a complaint, it must be submitted to us in writing, stating reasons, within 14 days of leaving the gîte.
